Associations are set up by persons or corporate bodies known as true beneficiaries having the same goals. For associations to be operative in the country, they must be registered with the Enterprise Register by filling out an application. An existing association is allowed to reorganize or make certain changes when the need arises. As stated in the Act, an association that wishes to make a change to the information in the Register must apply to the Enterprise Register a few days after the decision is made. If it decides to change its legal address, a notification shall be made for entry in the Register of Associations and Foundations. The processing of the application for change to a legal address of an association takes seven days.

Steps to changing the legal address of an association

There are four basic steps in the process of changing the legal address of an association within a country. To register this change, follow the steps listed below:

  • Checking the Address
  • Complete the registration form
  • Payment of state fees
  • Submitting required documents

Checking the address

The official office of an association is the address recorded in the register of associations and foundations. This is where all documents and correspondents from other institutions are sent to. If information or documents are sent to the registered address of the office, the Enterprise Register assumes they are received by the association within seven days. This indicates that the association must be in touch with its registered office.  There are certain conditions to be met for the registration of a registered office:

  • The office must be the same as the address recorded in the State Address Register
  • If the immovable property has many rooms, the registered office room count is significant

Completing the registration form

The application form B3 for changes to a legal address must be signed by all members of the board of the society, noting the type of rights of representation of the board members as agreed upon in the article of Association. The form has to contain details of the type of change, as there are several types of changes that can be made to an association. Aside from this, it should include the new information to be entered in the register. 

Payment of the fees

State fees are paid to the Treasury account at least one day afore to submitting the application form and required documents. The payment should be made to the account at any bank within the country. The application is processed, and registration is made after the Enterprise Register confirms the payment of the fee. The fee can be made in person, via a debit card, or by wire transfer from anywhere. The state fee for the registration is 5,69 EUR and shall be transferred to the Treasury account with these details:

Submitting the required documents

Aside from the application form B3, certain documents must be submitted alongside the form. These documents may be submitted electronically or by mail. They must be backed by a mandate if a third party submits them on behalf of the association. The documents to be submitted include:

  • A receipt or a copy of the payment of the state fee
